The answer to that question depends on many factors and you will need our office to do a complete analysis of your situation. First to be considered, is whether or not you pass the Means Test. This is based on your average gross income over the past 6 months. Even if you do not pass initially a more in depth analysis can be done and quite often you end up passing and can go forward with a chapter 7. Another thing to be considered is what your goals are in filing a Bankruptcy. If you are behind in mortgage payments, you may want to file a chapter 13 which allows the payment of arrears over a 3-5 year period. A Bankruptcy attorney is the only one who can answer your legal questions.
